The Minutes of the meeting held on 14 August 2017 were confirmed as a correct record and signed by the Chairman.

EXCLUSION OF PRESS AND PUBLIC

The Committee is asked to resolve:

 

That under Section 100(A)(2) and (4) of the Local Government Act 1972, the press and public be now excluded from the meeting for item 6 on the grounds that it involves the likely disclosure of confidential or exempt information as defined in Section 100A(3) and Paragraph 1 (personal information), 2 (individual identity) and 3 (private financial or business information) of Part 1 of Schedule 12A of the said Act (as amended).

 

In resolving to exclude the public in respect of the exempt information, it is considered that the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

DETERMINATION OF A REVIEW OF A HACKNEY CARRIAGE DRIVER LICENCE

Exempt report of the Executive Director (Public Protection, Planning and Governance) on the determination of a review of a Hackney Carriage Driver’s Licence.

The driver, Mr P had sent a letter on 13 October 2017 stating that he was unable to attend the meeting and a formal request for an adjournment had been received from his legal representatives on the grounds that there had been insufficient time to organise the conduct of the case since Mr P had been notified in writing of the date of the meeting on 4 October 2017.

 

In accordance with the “Picton” principles for regulatory proceedings as advised by the Senior Litigation Officer and having regard to the rules of natural justice, the Committee agreed to the request for an adjournment to a new date to be arranged which the driver must attend.

 

The witness who was involved in the incident with the driver, Mr M did attend the meeting and the Chairman explained to him that the meeting was being adjourned and the reasons for this.
